Rules of War and Offers of Peace
Moses gives Israel rules for warfare: the priest is to encourage the people before battle, and the officers are to send home anyone who has built a new house, planted a vineyard, become engaged, or is afraid. Cities far away must first be offered peace; if they accept, their inhabitants become forced laborers, otherwise the men are killed and the women, children, and spoils taken. The cities of the peoples in the land itself are to be devoted to destruction. Fruit trees must not be cut down during a siege.
5. Mooseksen kirja 20,1-20
1When you go out to war against your enemies and see horses and chariots and an army greater than your own, do not be afraid of them, for the LORD your God, who brought you up out of the land of Egypt, is with you.
כִּֽי־תֵצֵ֨א לַמִּלְחָמָ֜ה עַל־אֹיְבֶ֗יךָ וְֽרָאִ֜יתָ ס֤וּס וָרֶ֙כֶב֙ עַ֚ם רַ֣ב מִמְּךָ֔ לֹ֥א תִירָ֖א מֵהֶ֑ם כִּֽי־יְהוָ֤ה אֱלֹהֶ֙יךָ֙ עִמָּ֔ךְ הַמַּֽעַלְךָ֖ מֵאֶ֥רֶץ מִצְרָֽיִם׃
2When you are about to join battle, the priest shall come forward and speak to the troops.
וְהָיָ֕ה כְּקָֽרָבְכֶ֖ם אֶל־הַמִּלְחָמָ֑ה וְנִגַּ֥שׁ הַכֹּהֵ֖ן וְדִבֶּ֥ר אֶל־הָעָֽם׃
3He shall say to them: Hear, O Israel, today you are going into battle against your enemies. Do not lose heart. Do not be afraid, do not panic, and do not tremble before them,
וְאָמַ֤ר אֲלֵהֶם֙ שְׁמַ֣ע יִשְׂרָאֵ֔ל אַתֶּ֨ם קְרֵבִ֥ים הַיּ֛וֹם לַמִּלְחָמָ֖ה עַל־אֹיְבֵיכֶ֑ם אַל־יֵרַ֣ךְ לְבַבְכֶ֗ם אַל־תִּֽירְא֧וּ וְאַֽל־תַּחְפְּז֛וּ וְאַל־תּֽ͏ַעַרְצ֖וּ מִפְּנֵיהֶֽם׃
4for the LORD your God goes with you, to fight for you against your enemies and to save you.
כִּ֚י יְהוָ֣ה אֱלֹֽהֵיכֶ֔ם הַהֹלֵ֖ךְ עִמָּכֶ֑ם לְהִלָּחֵ֥ם לָכֶ֛ם עִם־אֹיְבֵיכֶ֖ם לְהוֹשִׁ֥יעַ אֶתְכֶֽם׃
5Then the officers shall say to the troops: Is there a man who has built a new house and not yet dedicated it? Let him go back home, or he may die in the battle and another man dedicate it.
וְדִבְּר֣וּ הַשֹּֽׁטְרִים֮ אֶל־הָעָ֣ם לֵאמֹר֒ מִֽי־הָאִ֞ישׁ אֲשֶׁ֨ר בָּנָ֤ה בַֽיִת־חָדָשׁ֙ וְלֹ֣א חֲנָכ֔וֹ יֵלֵ֖ךְ וְיָשֹׁ֣ב לְבֵית֑וֹ פֶּן־יָמוּת֙ בַּמִּלְחָמָ֔ה וְאִ֥ישׁ אַחֵ֖ר יַחְנְכֶֽנּוּ׃
6Is there a man who has planted a vineyard and not yet enjoyed its fruit? Let him go back home, or he may die in the battle and another man enjoy it.
וּמִֽי־הָאִ֞ישׁ אֲשֶׁר־נָטַ֥ע כֶּ֙רֶם֙ וְלֹ֣א חִלְּל֔וֹ יֵלֵ֖ךְ וְיָשֹׁ֣ב לְבֵית֑וֹ פֶּן־יָמוּת֙ בַּמִּלְחָמָ֔ה וְאִ֥ישׁ אַחֵ֖ר יְחַלְּלֶֽנּוּ׃
7Is there a man who is engaged to a woman and has not yet married her? Let him go back home, or he may die in the battle and another man marry her.
וּמִֽי־הָאִ֞ישׁ אֲשֶׁר־אֵרַ֤שׂ אִשָּׁה֙ וְלֹ֣א לְקָחָ֔הּ יֵלֵ֖ךְ וְיָשֹׁ֣ב לְבֵית֑וֹ פֶּן־יָמוּת֙ בַּמִּלְחָמָ֔ה וְאִ֥ישׁ אַחֵ֖ר יִקָּחֶֽנָּה׃
8The officers shall speak to the troops again and say: Is there a man who is afraid and faint of heart? Let him go back home, so that he does not make his brothers' hearts melt like his own.
וְיָסְפ֣וּ הַשֹּׁטְרִים֮ לְדַבֵּ֣ר אֶל־הָעָם֒ וְאָמְר֗וּ מִי־הָאִ֤ישׁ הַיָּרֵא֙ וְרַ֣ךְ הַלֵּבָ֔ב יֵלֵ֖ךְ וְיָשֹׁ֣ב לְבֵית֑וֹ וְלֹ֥א יִמַּ֛ס אֶת־לְבַ֥ב אֶחָ֖יו כִּלְבָבֽוֹ׃
9When the officers have finished speaking to the troops, they shall appoint army commanders at the head of the people.
וְהָיָ֛ה כְּכַלֹּ֥ת הַשֹּׁטְרִ֖ים לְדַבֵּ֣ר אֶל־הָעָ֑ם וּפָ֥[t]קְד֛וּ שָׂרֵ֥י צְבָא֖וֹת בְּרֹ֥אשׁ הָעָֽם׃ ס
10When you advance on a city to attack it, first offer it terms of peace.
כִּֽי־תִקְרַ֣ב אֶל־עִ֔יר לְהִלָּחֵ֖ם עָלֶ֑יהָ וְקָרָ֥אתָ אֵלֶ֖יהָ לְשָׁלֽוֹם׃
11If it accepts your offer of peace and opens its gates to you, then all the people found in it shall serve you as forced laborers.
וְהָיָה֙ אִם־שָׁל֣וֹם תַּֽעַנְךָ֔ וּפָתְחָ֖ה לָ֑ךְ וְהָיָ֞ה כָּל־הָעָ֣ם הַנִּמְצָא־בָ֗הּ יִהְי֥וּ לְךָ֛ לָמַ֖ס וַעֲבָדֽוּךָ׃
12But if it refuses peace and makes war against you, then lay siege to it.
וְאִם־לֹ֤א תַשְׁלִים֙ עִמָּ֔ךְ וְעָשְׂתָ֥ה עִמְּךָ֖ מִלְחָמָ֑ה וְצַרְתָּ֖ עָלֶֽיהָ[t]׃
13When the LORD your God gives it into your hand, put every male in it to the sword.
וּנְתָנָ֛הּ יְהוָ֥ה אֱלֹהֶ֖יךָ בְּיָדֶ֑ךָ וְהִכִּיתָ֥ אֶת־כָּל־זְכוּרָ֖הּ לְפִי־חָֽרֶב׃
14But the women, the children, the livestock, and everything else in the city—all its spoil—you may take as plunder for yourself, and you may use the spoil of your enemies that the LORD your God has given you.
רַ֣ק הַ֠נָּשִׁים וְהַטַּ֨ף וְהַבְּהֵמָ֜ה וְכֹל֩ אֲשֶׁ֨ר יִהְיֶ֥ה בָעִ֛יר כָּל־שְׁלָלָ֖הּ תָּבֹ֣ז לָ֑ךְ וְאָֽכַלְתָּ֙ אֶת־שְׁלַ֣ל אֹיְבֶ֔יךָ אֲשֶׁ֥ר נָתַ֛ן יְהוָ֥ה אֱלֹהֶ֖יךָ לָֽךְ׃
15This is how you shall treat all the cities that lie very far from you, cities that are not among the cities of these nations.
כֵּ֤ן תַּעֲשֶׂה֙ לְכָל־הֶ֣עָרִ֔ים הָרְחֹקֹ֥ת מִמְּךָ֖ מְאֹ֑ד אֲשֶׁ֛ר לֹא־מֵעָרֵ֥י הַגּֽוֹיִם־הָאֵ֖לֶּה הֵֽנָּה׃
16But in the cities of these peoples that the LORD your God is giving you as an inheritance, you shall leave nothing alive that breathes.
רַ֗ק מֵעָרֵ֤י הָֽעַמִּים֙ הָאֵ֔לֶּה אֲשֶׁר֙ יְהוָ֣ה אֱלֹהֶ֔יךָ נֹתֵ֥ן לְךָ֖ נַחֲלָ֑ה לֹ֥א תְחַיֶּ֖ה כָּל־נְשָׁמָֽה׃
17You shall devote them to destruction—the Hittites, the Amorites, the Canaanites, the Perizzites, the Hivites, and the Jebusites—just as the LORD your God has commanded you,
כִּֽי־הַחֲרֵ֣ם תַּחֲרִימֵ֗ם הַחִתִּ֤י וְהָאֱמֹרִי֙ הַכְּנַעֲנִ֣י וְהַפְּרִזִּ֔י הַחִוִּ֖י וְהַיְבוּסִ֑י כַּאֲשֶׁ֥ר צִוְּךָ֖ יְהוָ֥ה אֱלֹהֶֽיךָ׃
18so that they may not teach you to imitate all the detestable things they do for their gods, and so you sin against the LORD your God.
לְמַ֗עַן אֲשֶׁ֨ר לֹֽא־יְלַמְּד֤וּ אֶתְכֶם֙ לַעֲשׂ֔וֹת כְּכֹל֙ תּֽוֹעֲבֹתָ֔ם אֲשֶׁ֥ר עָשׂ֖וּ לֵֽאלֹהֵיהֶ֑ם וַחֲטָאתֶ֖ם לַיהוָ֥ה אֱלֹהֵיכֶֽם׃ ס
19When you besiege a city for a long time, waging war against it in order to capture it, do not destroy its trees by taking an axe to them; you may eat from them, but you shall not cut them down. Are the trees of the field human, that you should besiege them too?
כִּֽי־תָצ֣וּר אֶל־עִיר֩ יָמִ֨ים רַבִּ֜ים לְֽהִלָּחֵ֧ם עָלֶ֣יהָ לְתָפְשָׂ֗הּ לֹֽא־תַשְׁחִ֤ית אֶת־עֵצָהּ֙ לִנְדֹּ֤חַ עָלָיו֙ גַּרְזֶ֔ן כִּ֚י מִמֶּ֣נּוּ תֹאכֵ֔ל וְאֹת֖וֹ לֹ֣א תִכְרֹ֑ת כִּ֤י הֽ͏ָאָדָם֙ עֵ֣ץ הַשָּׂדֶ֔ה לָבֹ֥א מִפָּנֶ֖יךָ בַּמָּצֽוֹר׃
20Only trees that you know are not fruit trees may you destroy and cut down, to build siegeworks against the city that is waging war with you, until it falls.
רַ֞ק עֵ֣ץ אֲשֶׁר־תֵּדַ֗ע כִּֽי־לֹא־עֵ֤ץ מַאֲכָל֙ ה֔וּא אֹת֥וֹ תַשְׁחִ֖ית וְכָרָ֑תָּ וּבָנִ֣יתָ מָצ֗וֹר עַל־הָעִיר֙ אֲשֶׁר־הִ֨וא עֹשָׂ֧ה עִמְּךָ֛ מִלְחָמָ֖ה עַ֥ד רִדְתָּֽהּ׃ פ
