When you go out to war against your enemies and see horses and chariots and an army greater than your own, do not be afraid of them, for the LORD your God, who brought you up out of the land of Egypt, is with you.

When you are about to join battle, the priest shall come forward and speak to the troops.

He shall say to them: Hear, O Israel, today you are going into battle against your enemies. Do not lose heart. Do not be afraid, do not panic, and do not tremble before them,

for the LORD your God goes with you, to fight for you against your enemies and to save you.

Then the officers shall say to the troops: Is there a man who has built a new house and not yet dedicated it? Let him go back home, or he may die in the battle and another man dedicate it.

Is there a man who has planted a vineyard and not yet enjoyed its fruit? Let him go back home, or he may die in the battle and another man enjoy it.

Is there a man who is engaged to a woman and has not yet married her? Let him go back home, or he may die in the battle and another man marry her.

The officers shall speak to the troops again and say: Is there a man who is afraid and faint of heart? Let him go back home, so that he does not make his brothers' hearts melt like his own.

When the officers have finished speaking to the troops, they shall appoint army commanders at the head of the people.

When you advance on a city to attack it, first offer it terms of peace.

If it accepts your offer of peace and opens its gates to you, then all the people found in it shall serve you as forced laborers.

But if it refuses peace and makes war against you, then lay siege to it.

When the LORD your God gives it into your hand, put every male in it to the sword.

But the women, the children, the livestock, and everything else in the city—all its spoil—you may take as plunder for yourself, and you may use the spoil of your enemies that the LORD your God has given you.

This is how you shall treat all the cities that lie very far from you, cities that are not among the cities of these nations.

But in the cities of these peoples that the LORD your God is giving you as an inheritance, you shall leave nothing alive that breathes.

You shall devote them to destruction—the Hittites, the Amorites, the Canaanites, the Perizzites, the Hivites, and the Jebusites—just as the LORD your God has commanded you,

so that they may not teach you to imitate all the detestable things they do for their gods, and so you sin against the LORD your God.

When you besiege a city for a long time, waging war against it in order to capture it, do not destroy its trees by taking an axe to them; you may eat from them, but you shall not cut them down. Are the trees of the field human, that you should besiege them too?

Only trees that you know are not fruit trees may you destroy and cut down, to build siegeworks against the city that is waging war with you, until it falls.

The chapter mentions several roles within the Israelite military structure. The priest (הַכֹּהֵן, hakkohen) had a central function before battle by speaking encouraging words to the people (v. 2-4). According to Jewish tradition, this was a specially anointed priest for war (meshuach milchama). The officers (הַשֹּׁטְרִים, hashotrim) were civil officials who handled exemptions from military service (v. 5-9). They were not military leaders but administrative functionaries. The commanders of the army (שָׂרֵי צְבָאוֹת, sare tseva'ot) were appointed after the exemptions had been granted and led the remaining soldiers.

Events and Customs

Exemption from military service (v. 5-8) represents a unique arrangement in the ancient Near East. Three categories received exemption: the one who had built a new house without dedicating it, the one who had planted a vineyard without harvesting its fruit, and the one who was engaged but not yet married. A fourth category applied to those who were afraid. The reasoning was twofold: partly humanitarian concern that a man should enjoy the fruits of his labor, and partly practical—fearful soldiers could demoralize others. Similar exemptions are not documented in other ancient cultures to the same extent.

Warfare against distant cities (v. 10-15) was to begin with an offer of peace. If the city accepted, its inhabitants became forced laborers (mas, tribute labor). This was standard practice in the ancient Near East, known from Assyrian and Egyptian sources. Warfare against Canaanite cities (v. 16-18) was subject to herem—total destruction. This differed radically from the treatment of distant cities and was justified by the need to prevent religious influence.

Key Terms

The word חֲנָכוֹ (chanako, "dedicate it", v. 5) is used for taking a new house into use for the first time. This dedication likely involved a religious ceremony. The same root appears in the later word chanukka (dedication festival).

The term חִלְּלוֹ (chillelo, "make it common/available", v. 6) regarding the vineyard refers to the rule that fruit from new trees was forbidden for the first three years, holy in the fourth year, and only available in the fifth year (Lev 19:23-25). To "profane" the vineyard thus meant to harvest the first permitted crop.

The war regulations in this chapter can be compared with war laws from other ancient cultures. Assyrian annals often describe brutal treatment of defeated cities without offers of peace. The Israelite requirement for an offer of peace before attack (v. 10) represents a modified approach. The prohibition against cutting down fruit trees during siege (v. 19-20) is remarkable, as Assyrian reliefs frequently show exactly such systematic destruction of enemy gardens and fruit trees as war tactics.
